Mr & Mrs Scott
Mr & Mrs Scott were recently married and came to see us in relation to their purchase of a new home.
The property was to be purchased by virtue of a joint mortgage and from the sale proceeds of Mrs Scott's recent sale of a property. Mrs Scott advised that she wished to protect her investment in the property and we prepared a declaration of trust setting out the contributions that were made by Mr & Mrs Scott and detailing how the sale proceeds were to be divided upon a later sale of the property. Had the declaration of trust not been drawn up the additional contribution made by Mrs Scott to the purchase price would not have been protected.
Mrs Jones second husband has two children by his first marriage.
The family home was in the name of Mr Jones in his sole name. Mrs Jones came to us as she was concerned about her security should her husband, who was terminally ill, died. We explained to Mrs Jones the implications to her should her husband die and her rights to remain in the family home. We explained that Mr Jones should make a Will and that he should consider transferring the property into joint names in order to secure her right to remain in the house after Mr Jones had passed away.
